Declaration of Compliance and Commitment to Due Diligence

Grantseekers should review the following sections thoroughly.  Grantseekers are required to respond to an eligibility pre-screening quiz as part of the application process.

Eligibility Quiz

Before beginning the application process, a grantseekers are asked to consider and respond to a series of eligibility questions.  BCF and its Donor Fund programmes fund a wide variety of projects – large and small- every year through a variety of strategic initiatives and donor-advised field of interest grants.  Our ultimate goal is to build reserves to support the great work of the local nonprofit sector.  Even though our focus is endowments, and investing and administering donor funds, we help people give effectively and efficiently.  In addition being able to demonstrate that the work you, as a grantseeker does contributes to improving life in Bermuda, you should be able to indicate that:

1.       You are a locally based nonprofit, voluntary or community group working in Bermuda to improve the quality of life for local people

2.       You have an active Board or management committee

3.       You have a current governing document, i.e. Constitution, Bye-laws signed and dated

4.       You have a bank account in the name of your organization

5.       You have up to date financial accounts

Compliance and Commitment to Due Diligence


Grantseekers should review the following statements and agree to their compliance.  If your response to one or more of the statements is “false” or “no”, please contact us at Admin@bcf.bm to discuss the response and enable us to gather more information about your entity or your request.  A “false” or “no” response in and of itself, in no way disqualifies a potential applicant but we do like to have a discussion with you to assess your eligibility before you go through the robust application process.

BCF’s Declaration of Compliance and Commitment to Due Diligence

  1. My attention has been drawn to Section 8 of The Charities Act, 2014 which obliges the treasurer or other person having supervision of the accounts of a registered charitable organisation to submit a true copy of those accounts to the Registrar General within six months of the end of each financial year of the organisation.
  2. My attention has also been drawn to Section 4 of the Registration of Charities Regulations, 1980 which obliges the secretary or other persons having custody of the records of a registered charitable organisation to notify the Registrar General of any alterations in the particulars of the organisation (change of name, change of officers, amendments to the constitution etc.), and that such notification must be filed within thirty days of the alteration.
  3. Our organisation is controlled and operates independently from any other organization.
  4. Our organisation is not related (other than by association) through common membership, governing bodies, trustees, officers, etc. to any other charity or nonprofit organisation.
  5. Our business (programmes, funding, investments, etc.) is carried on primarily in Bermuda.
  6. Our organisation is not registered in any other country (as a charity or otherwise).
  7. Our organisation does not permit any or all of its income or assets to be distributed to, or applied for the benefit of, a private person or non-charitable organisation other than as payment of reasonable compensation for services rendered, or as payment representing the fair market value of property which our organisation has purchased.
  8. Our organisation has no shareholders or members who have an interest in the income or assets of the organisation.
  9. In the event that our organisation were to be liquidated or dissolved, all its assets would be distributed to another not-for-profit organisation for charitable, religious, scientific, literary, or educational purposes, or to a government agency.
  10. Our activities do not feature a political party, a religious organisation or an individual.
  11. Disclosure of Your Personal Information and Financial Information in Compliance with Laws: We are aware that BCF may release your personal information or financial information when BCF believes it is necessary to comply with laws or regulations, to assist law enforcement, to enforce the terms under which you transacted with BCF, or to protect the rights, property or safety of BCF, users of the Site or others.
  12. Ownership of Materials:

We are aware that all materials on BCF website are copyrighted and are protected under treaty provisions and world-wide copyright laws. BCFs materials may not be reproduced, copied, edited, published, transmitted or uploaded in any way without BCF written permission. Except as expressly stated in the limited license provision of these terms and conditions, BCF does not grant any express or implied right to you under any of its trademarks, copyrights or other proprietary information.

13. Permitted Use: You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review your nonprofit/philanthropic information, for personal use, unless otherwise specifically authorized by BCF to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorized by us to do so. The content and software on this Site is the property of the BCF and/or its suppliers and is protected by Bermuda and international copyright laws.

14. Disclosure of Your Personal Information and Financial Information in Compliance with Laws:  You are aware that BCF may release your personal information or financial information when BCF believes it is necessary to comply with laws or regulations, to assist law enforcement, to enforce the terms under which you transacted with BCF, or to protect the rights, property or safety of BCF, users of the Site or others.
